Complete terms and conditions for All State Movers services

This Agreement (the "Agreement") is entered into by and between All State Movers, a Federal Motor Carrier Safety Administration (FMCSA)-authorized household goods motor carrier (hereinafter referred to as "All State Movers" or "Carrier"), and the undersigned customer (hereinafter referred to as "Customer"), collectively referred to as the "Parties."
The provisions herein constitute the entire understanding and agreement between the Parties with respect to the transportation of Customer's household goods and supersede all prior negotiations, understandings, and representations, whether written or oral, including but not limited to any representations made by any estimator. In the event of any conflict between the terms of any estimate and the bill of lading, the terms of the bill of lading shall prevail. This Agreement may not be amended, supplemented, or waived except by a writing signed by both All State Movers and the Customer.
The Customer shall not assign, delegate, or otherwise transfer any rights or obligations under this Agreement without the prior written consent of All State Movers.
Nothing in this Agreement, whether express or implied, is intended to confer any rights, benefits, or remedies upon any person or entity other than the Parties and their respective legal representatives, successors, or permitted assigns. This Agreement shall not relieve or discharge the obligations or liabilities of any third party to either Party, nor shall it grant any third party any right of subrogation or action against either Party.
All State Movers is an FMCSA-authorized household goods motor carrier. In the event that the Customer's route is outside the Carrier's service area or a scheduling conflict arises, All State Movers may, in its capacity as a broker, arrange for the transportation of the Customer's household goods by another FMCSA-authorized motor carrier within its network.
If applicable, All State Movers shall notify the Customer of the designated carrier prior to the moving date. The Customer acknowledges that all claims, including but not limited to claims for property damage, personal injury, or death, shall be pursued directly against the carrier performing the transportation services.
In its capacity as a properly licensed interstate moving coordinator, shipper, agent, or broker, All State Movers does not act as a motor carrier unless expressly performing transportation services. When acting as a broker, All State Movers will not transport the Customer's household goods but will coordinate and facilitate transportation by an FMCSA-authorized motor carrier.
Important Notice: All State Movers does not guarantee specific pick-up or delivery dates or times under any circumstances.
The Customer agrees to pay the total charges for the transportation and related services provided by All State Movers. The reservation deposit represents only a portion of the total estimated charges for scheduling and routing purposes and is non-refundable upon placement of the reservation.
The Customer has elected a binding price, whereby the total cost shall not exceed the estimated amount, provided the Customer provides All State Movers with an accurate inventory of items to be moved and a complete list of requested additional services, in accordance with 49 CFR 371.113(1).
All pick-up, load, and delivery dates are estimates only. All State Movers shall not be liable for losses or damages resulting from unavoidable delays. All State Movers will act on behalf of the Customer to resolve any claims or delay issues with the carrier.
No guarantees, express or implied, are made regarding pack, load, or delivery dates. Delays may occur due to inclement weather, mechanical breakdowns, road construction, remote locations, or other factors beyond our control.
All State Movers participates in the Motor Carrier Neutral Arbitration Program, designed to provide a fair and neutral process for resolving disputes between the carrier and the Customer, as provided under 49 U.S.C. § 375.211.
Each Party bears 50% of arbitrator costs and 100% of their own expenses, including attorneys' fees. Arbitration may be a less costly alternative to litigation.
Important Legal Notice
The Customer knowingly, voluntarily, and intentionally waives the right to a trial by jury in any litigation arising out of or relating to this Agreement, the transportation services, or any course of conduct, dealing, statements (whether verbal or written), or actions of All State Movers or its agents. This waiver is a material inducement for All State Movers to enter into this Agreement.
The Customer hereby covenants and agrees to address any concerns or disputes arising from this Agreement in a professional manner by communicating directly with All State Movers' designated moving coordinator.
The Customer shall refrain from making any public statements, comments, or representations that could reasonably be construed as defamatory, disparaging, or damaging to the reputation of All State Movers until providing a reasonable opportunity to address and resolve concerns through proper dispute resolution procedures.
Any breach of this provision shall result in immediate forfeiture of the Customer's deposit and dismissal of any claims asserted against All State Movers.
Any refusal or denial of service, whether verbal, in-person, or telephonic, shall be treated as a late cancellation outside the designated cancellation window, resulting in forfeiture of the Customer's deposit and potential liability for the remaining unpaid balance of the estimate.
Customer is responsible for providing proof of service denial. All State Movers is not required to obtain signed documentation verifying service refusal.
This Agreement shall be governed by and construed in accordance with the internal laws of the State of North Carolina, without regard to its conflict of law principles.
In any controversy arising under this Agreement, All State Movers shall be entitled to recover all court costs, collection fees, expenses, and reasonable attorneys' fees, including those incurred in pre-trial and appellate proceedings.
By allowing All State Movers or its designated carrier to pick up the Customer's belongings, the Customer acknowledges and consents to the terms and conditions of this Agreement, even if the Agreement is not executed or returned.
